The CFedS Panel has approved a new continuing education course designed to familiarize CFedS with several key IBLA decisions. The course will consist of the following elements:
- Read the Stoddard Jacobsen and Robert C. Downer 85 IBLA 335, 97 IBLA 182 and 103 IBLA 83 case which is located under the IBLA section of the CFedS website.
- You must pass a test on the subject matter on the CFedS website.
This case deals with the evaluation and documentation of evidence and the proper standard of evidence to be applied when declaring a corner existent. It involves 3 separate decisions by the Board and contains some excellent information about how a court will evaluate the record.
Upon completion of this course, students will be able to organize and document evidence related to the lines and corners of the original survey and identify the proper standard of evidence to be applied when declaring a corner existent.
Approximately 8 hours
Upon reaching the final quiz, you must answer at least 80% of the questions correctly to achieve a passing grade. Retakes are limited to once per 24 hour period.
